Terms of Service

Legal terms and conditions for Roofing of Portsmouth services and website usage

Welcome to Roofing of Portsmouth

These Terms of Service ("Terms") govern your use of the Roofing of Portsmouth website, services, and all related platforms. By accessing our website, requesting a quote, scheduling service, or engaging with Roofing of Portsmouth in any capacity, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.

1. Service Conditions

1.1 Scope of Services

Roofing of Portsmouth provides roofing repair, replacement, inspection, and related services as described on our website and in written quotes. All services are performed in accordance with Virginia roofing codes and industry standards. The scope of work is determined by the written estimate or contract provided at the time of service request.

1.2 Service Scheduling

Services are scheduled based on availability and customer preference. While we strive to provide prompt service, including same-day emergency response, actual availability depends on current workload, weather conditions, and other factors beyond our control. Emergency services are available 24/7 for urgent roof leaks and storm damage.

1.3 Site Access and Safety

Customers must provide safe access to the roof and work area. The customer is responsible for informing us of any hazards, pets, or special conditions that may affect service. Roofing of Portsmouth reserves the right to refuse service if site conditions pose unreasonable safety risks to our crew or equipment.

1.4 Weather and Conditions

Roofing work may be delayed or rescheduled due to rain, high winds, extreme temperatures, or other weather conditions that make work unsafe or impossible. We will notify you of any weather-related delays as soon as possible.

2. Payment Terms

2.1 Estimates and Quotes

Free estimates are provided in writing and are valid for 30 days from the date of issue unless otherwise stated. Estimates are based on information provided by the customer and site conditions observed during the inspection. Actual costs may vary if additional damage or unforeseen conditions are discovered during work.

2.2 Payment Methods

We accept cash, checks, credit cards, debit cards, and digital payment methods. Payment terms will be specified in the service agreement or invoice. A 50% deposit may be required for large projects, with the balance due upon completion.

2.3 Invoicing and Payment Due

Invoices are provided upon completion of work unless other arrangements are made. Payment is due within the timeframe specified on the invoice. Late payments may incur a finance charge of 1.5% per month on the outstanding balance, or the maximum rate allowed by Virginia law, whichever is less.

2.4 Insurance Claims

If work is covered by homeowner's insurance, the customer is responsible for submitting the claim and coordinating with their insurance provider. We can provide documentation and photos to support claims. Payment from insurance may be applied to the invoice balance.

2.5 Price Changes

Prices quoted are based on current material and labor costs. If unforeseen conditions require additional work beyond the original scope, we will notify you and provide an updated estimate before proceeding.

3. Warranty Information

3.1 Workmanship Warranty

Roofing of Portsmouth warrants all workmanship against defects in materials and labor for a period of two (2) years from the date of service completion. This warranty covers repairs and installations performed by our crew and applies to labor only, not to material defects.

3.2 Material Warranties

Material warranties are provided by the manufacturers of roofing products used in the work. Roofing of Portsmouth will pass through manufacturer warranties to the customer. Customers should review manufacturer documentation for specific coverage details, exclusions, and claim procedures.

3.3 Warranty Exclusions

Warranties do not cover damage caused by improper maintenance, weather events beyond normal conditions, acts of God, customer modifications to the roof, or use of non-approved materials. Warranties are void if repairs are performed by unauthorized parties.

3.4 Warranty Claims

To file a warranty claim, contact Roofing of Portsmouth within the warranty period with photos and a description of the issue. We will inspect the work and determine if the claim is covered. Warranty repairs will be performed at no charge if covered.

3.5 No Other Warranties

Except as stated above, Roofing of Portsmouth makes no other warranties, express or implied, including warranties of merchantability or fitness for a particular purpose. Some states do not allow the exclusion of implied warranties, so these limitations may not apply to you.

4. Liability Limitations

4.1 Insurance and Liability

Roofing of Portsmouth carries liability insurance as required by Virginia law. Our crew is fully insured and bonded. In the event of damage or injury during service, claims will be handled through our insurance carrier.

4.2 Limitation of Damages

To the maximum extent permitted by law, Roofing of Portsmouth's total liability for any claim arising from these Terms or our services shall not exceed the amount paid for the services that gave rise to the claim. This includes liability for indirect, incidental, consequential, or punitive damages.

4.3 Customer Responsibility

The customer is responsible for protecting personal property in the work area. Roofing of Portsmouth is not responsible for damage to landscaping, vehicles, or other property unless such damage is caused by our negligence or willful misconduct.

4.4 Acts Beyond Our Control

Roofing of Portsmouth is not liable for delays, damages, or failure to perform services due to acts of God, natural disasters, extreme weather, government action, or other circumstances beyond our reasonable control.

Arbitration will be conducted under the rules of the American Arbitration Association.

7.5 Statute of Limitations

Any claim arising from these Terms or our services must be brought within one (1) year of the date the claim arises, or the claim is forever barred.

8. Cancellation and Refund Policy

8.1 Cancellation of Scheduled Services

Customers may cancel scheduled services up to 48 hours in advance without penalty. Cancellations made within 48 hours of the scheduled appointment may be subject to a cancellation fee equal to 25% of the estimated service cost or a minimum of $50.

8.2 Refunds

Refunds for completed services are available only if work does not meet the standards outlined in these Terms or if the customer is not satisfied with the workmanship. Refund requests must be submitted in writing within 14 days of service completion.

8.3 Partial Refunds

If a refund is approved, it will be issued for the portion of work that does not meet acceptable standards. Refunds do not include materials that have been used or installed.

9. Changes to Terms

9.1 Right to Modify

Roofing of Portsmouth reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services following the posting of revised Terms means you accept and agree to the changes.
